Welcome to Holy Smokas. By using our website creation services, you agree to these Terms of Service. Please read them carefully.

1. Services Overview

Holy Smokas provides AI-powered website creation services for small businesses. Our services include:

• Custom website design and development
• Website hosting via GitHub Pages (free, included)
• Domain registration (optional, additional cost)
• Admin dashboard for content management
• Google Drive integration for image storage
• Up to 3 free website modifications after delivery

2. Pricing and Payment

One-Time Payment Model: Holy Smokas operates on a "pay once, own forever" model. Our packages include:

• Starter Website: $599
• Business Website: $1,199
• Small Shop: $1,699
• Enterprise/E-Commerce: Custom Quote

Payments are processed securely through Stripe. All sales are final once website generation has begun. Domain registration fees are separate and based on current market pricing.

3. Website Delivery

After payment confirmation:

• Your website will be generated automatically using AI
• Typical delivery time is 5-15 minutes
• You will receive an email with your live website URL
• You must create an account to access your dashboard and make modifications

4. Free Modifications

Each website package includes up to 3 free modifications. Modifications can include:

• Text and content changes
• Color scheme adjustments
• Layout modifications
• Adding or removing sections

Additional modifications beyond the free limit are billed at $75/hour.

5. Hosting and Ownership

Free Hosting: Your website is hosted on GitHub Pages at no additional cost. There are no monthly hosting fees.

Code Ownership: You own the generated website code. The code is stored in a GitHub repository that you have full access to.

Domain Ownership: If you purchase a domain through us, it is registered in your name through Namecheap. You own the domain and can transfer it at any time.

6. Google Drive Integration

For packages with product/image upload capabilities:

• You may connect your own Google Drive for image storage
• This uses your Google Drive's free 15GB storage
• We only access files created by our application
• You maintain full ownership and control of your data
• Disconnecting Google Drive may affect image functionality on your site

7. Acceptable Use

You agree NOT to use our services to create websites that:

• Contain illegal content or promote illegal activities
• Infringe on intellectual property rights
• Contain malware, viruses, or malicious code
• Promote hate speech, violence, or discrimination
• Engage in fraud, phishing, or deceptive practices
• Violate any applicable laws or regulations

We reserve the right to refuse service or terminate websites that violate these terms.

8. Intellectual Property

Your Content: You retain all rights to content you provide (logos, images, text). You represent that you have the right to use all content you submit.

Generated Code: The website code generated for you becomes your property upon payment.

Our Branding: Holy Smokas branding, logos, and marketing materials remain our property.

9. Limitation of Liability

Holy Smokas provides websites "as is." We are not liable for:

• Loss of business or revenue
• Data loss (we recommend maintaining your own backups)
• Third-party service outages (GitHub, Google, Stripe, Namecheap)
• Issues arising from customer modifications to the code

Our total liability is limited to the amount you paid for services.

10. Refund Policy

Due to the automated nature of our service:

• Refunds are not available once website generation has begun
• If generation fails due to our error, we will regenerate or refund
• Domain registration fees are non-refundable once the domain is registered

11. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.

12. Account Termination

You may close your account at any time. Your website will remain live on GitHub Pages unless you delete the repository. We may terminate accounts that violate these terms.

13. Changes to Terms

We may update these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the new terms.

14. Governing Law

These terms are governed by the laws of the State of California, United States.
